Serving a valid Section 8 notice under a rolling tenancy

How do I evict a tenant legally without Section 21?

Since 1 May 2026, Section 21 no-fault evictions are abolished. Possession requires a Form 3A notice under Section 8 of the Housing Act 1988, relying on specific Schedule 2 grounds such as rent arrears (Ground 8), sale of the property (Ground 1A), or anti-social behaviour (Ground 14). This generator maps your situation to the correct grounds and builds the notice around them.

What is a Form 3A possession notice in England?

Form 3A is the prescribed notice for seeking possession of an assured rolling periodic tenancy in England under the Renters’ Rights Act. It replaced the old Section 8 notice format and must state the grounds, the statutory wording, and the earliest and latest dates for court proceedings.

Is this a Section 8 notice rent arrears template?

Yes, for arrears the tool maps mandatory Ground 8 (3 months or 13 weeks of arrears) plus discretionary Grounds 10 and 11, applies the statutory Universal Credit safeguard, and produces a Housing Act 1988 Schedule 2 grounds download built around your rent ledger figures.

Do I need a solicitor as well?

The packet is a solicitor-ready template with the structure, dates, and statutory wording assembled. We recommend having a qualified adviser review it before service; the packet is designed to make that review fast and cheap.
